SHIPPING POLICY

Jess Nicole Collections uses USPS as the shipping carrier responsible of delivering your order. Once a package has left our office and is scanned by an USPS employee, your package is on transit to you and you'll receive a tracking number via email. Please allow up to 24 hours for an USPS employee to update the tracking number. Once a package is on transit and you have any questions or concerns regarding shipping please contact USPS.

USPS is the shipping carrier responsible for delivering a package by estimated scheduled date/time given by your USPS tracking number. If USPS tried to deliver your package and you were not at the given address, you are responsible to reschedule a redelivery with USPS or responsible to pick up at your local post office. Jess Nicole Collections is not liable for any shipping delays due to inclement weather, holidays, natural disasters, USPS delays, order verification or incorrect/incomplete shipping addresses. Jess Nicole Collections is not responsible for any lost or stolen packages and to ensure you'll receive your package, tracking number and signature is required. 

Your order will be sent to the shipping address as inserted and provided to us by you when order was placed. Providing an incomplete and/or incorrect shipping address is one of the leading causes of shipping delays. Upon ordering, please ensure all delivery information is complete and accurate to ensure successful delivery. If you inserted the shipping address incomplete/incorrect, please contact us via email to correct this before order has shipped out. Once order is in transit. Jess Nicole Collections can no longer correct the address, therefore please contact USPS to correct your shipping address.

If an order is returned to us due to insufficient or incorrect address, you will be responsible for reshipment. Once package is returned to us due to failed delivery, we will contact you for the correct address to reship back to you at a additional charge of $10. Upon receiving your order back, you have up to 7 days to let us know if you would like your order reshipped at an additional reshipping cost, or if you no longer want the item(s), you will receive a partial refund. Items must be unworn, undamaged, with store tags and in original condition. To accommodate costs of processing your order, all returned items are subject to a 15% restocking fee. Original shipping charges incurred at the time of purchase are non-refundable.

CONTRACT SAMPLE PACKAGE  

The following outlines the steps of the process and spells out our mutual expectations please read this carefully in its entirety!

This Agreement is in effect on the date of _______________and the year of _______________. Between Jess Nicole Collections LLC  (the “Company”), and _____________________________________ (the “Client”). 

Date ___________Time________.

Jess Nicole Collections LLC  is responsible for creating the garments for the client, with the inspirational, ideas, photos, materials and or design details given by the client. The company is not allowed to duplicate other designers' work or make an exact replica but is allowed to make a variation of the design, by changing any materials such as; color, texture, print, pattern, fabric or embellishments. In providing the Services hereunder, the role of the Company shall be that of an independent contractor and not that of employee or agent of the Client.  The Company represents and warrants that it will conform to the standard of care, skill and diligence exercised by professionals performing the same or similar services provided for in this Agreement. We are available to clear and open communication. 

Custom Design Consultations

During your initial consultation which we discuss your vision and preferences as well as the price of your garment(s) , we will exchange and modify ideas until a final design is agreed upon, in these exchanges we will cover , fashion illustrations , discussion of fabric details, notion details, color, embellishments, garment styles and silhouette as well as fittings, alterations, and any further design details, These will be  agreed upon by both parties, before the production of any design. ___________ . Fittings and Alterations 

All fittings and alterations you do are covered in the price of the garments until they have been released to you. The garment may only be altered for no additional charge if it is still in possession of the designer and has not yet been released. Last minute alterations are solely up to the discretion of the designer, if time permits. If alterations are extensive additional fees may apply. We have a full-service commitment and we will work with you until the fit is right. We plan for 2-3 fittings up until the completion of the garments. If for any reason you choose to go elsewhere for alterations or adjustments, you (the client is responsible for those cost).  ________. (Initial Here)

Changes 

Designing and consulting custom dresses is a collaborative process that sometimes requires minor changes along the way. We can all expect this. Please let us know of any changes as early as possible before your fabric has been purchased, so that we can try to accommodate you in a timely manner.  If no concerns are addressed prior to purchase date, which is 1-3 days after the consultation date and a deposit is made, no said changes can be made without incurring additional fees. There will be no last-minute changes to the design or garment the week of or the day before the event under any circumstances.  ____________ . (Initial Here) 

I ____________________________ (the "Client”) understand that I am responsible for the payment of the garment(s), and any materials it takes to complete said garment(s).  I am also responsible for timely payments. If any extra materials are needed to complete the garment(s) I am responsible for the payment and purchasing of those materials. I understand that I cannot change the fabric once it has been purchased or once it has been cut out. Any changes to the initial design or the fabric, will incur additional fees, and must be approved by the company.  I also understand that any changes made to the design or fabric will extend the timeframe of the garments completion and incur additional rush fees. 

Limitation of Liability & Waiver to Sue.

Jess Nicole Collections LLC   is not responsible for any mishaps, i.e. rips, tears, broken seams, stains to the garment or any lost, stolen or damaged garment(s), once they are released to the “client” and are in the client’s possession and under the client’s care. Once you have signed your garment release form and picked up your garment, the garment(s) and its condition is your total responsibility. You agree that you waive your right to Sue or seek any sort of litigation against Jess Nicole Collections LLC  ,  its partners, its affiliates or employees. ____________. (Initial Here)

Delivery of Services 

Delivery for services shall be mutually agreed by both parties, but in no event later than ______________________, 20____the due date. The garment can be picked up from the company at its business address during normal hours of operation.  The company shall take reasonable steps to satisfy the client’s needs for services in a timely manner.  If this is a dress, or garment for a formal event, be it; proms, weddings or special occasions, the garment request must be made within 0ne (1-5) to five months prior to its due date to prevent time constraints. If the garment request are not made within the allowed times there will be an additional non-refundable late fee of $_______. 

Pick up Notice 

If you (the “Client”) pick up your garment on your set pick up date, and take it with you, any alterations after it is released to you (the “Client”) will require additional alteration fees. Once the garment is released to you and you have worn your garment to your event, you will not receive a refund or exchange for your garment(s). You have agreed that you are satisfied with your garment(s) once you have accepted them and they are in your possession.

Service Fee(s) 

The total cost of the garment is $___________ (the “Cost”). The initial down payment is half the cost of the labor + the cost of the fabric which is $______________________, and it is due prior to the commencement of any garment. All deposits and payments are non-refundable. This agreement will be null and void if no deposit is received for the service. Services on your garment will not commence until a deposit is made. Jasmine Rene LLC accepts installment payments of $ _________ once an initial deposit is made.  The payment covers the cost of materials and our investment to bring your garment to life. 

Form of Payment 

Jess Nicole Collections LLC  accepts all major credit cards, and cash only. NO CHECKS ARE ACCEPTED! A receipt of payment will be given after all transactions are made between the company and the client, via email or paper receipt. The cost of the garment may increase in price due to unforeseen events and the company shall immediately inform the client of any increase in cost. 

Cancellation(s)

Garment (s) are custom made for you, Jess Nicole Collections LLC  cannot accept any returns or exchanges for ANY reason. Once the client and designer and or affiliates have signed this agreement. I (the Client) understand that if I cancel the custom order or process of production for Any reason I will not receive a refund on prior services rendered or for any prior deposits given to Jess Nicole Collections LLC. If a client has cancelled an order, either by verbal, or written communication, Jess Nicole Collections LLC has the right to stop production of the order and use any remaining garments, fabrics or materials for company use. In the event of Force Majeure; natural and unavoidable catastrophes, pandemic or acts of God, that interrupt the expected course of events, Jess Nicole Collections LLC  is not liable to complete the order if such acts prohibit doing so. I have a full and complete understanding that All deposits and payments are non- refundable. ______________. (Initial Here)

Fabric Agreement  

Fabric and materials will not be ordered until the client has approved them and paid their initial deposit.  Once the client has approved the fabric and materials for their design and they have been purchased, fabric changes cannot be made unless the client pays an additional fee for both the additional labor and the new materials. Fees vary upon design. The fabric cannot be changed if the garment has already been cut out and created (sewn together) with the previous fabric that was selected. ____________. (Initial Here)

Terms of Payment 

The Garment will not be released until full payment for the garment is received by the Company, (no matter the circumstance).  The Garment is to be picked up by the Purchaser on the date of final payment.  The Garment may not be picked up prior to its completion or before final payment is received.  There will be (no discount or sales price deductions on custom designs or apparel).  

Commitments & Late fees 

If you are more than 30 minutes late to any of your scheduled appointments, there will be an additional $25 fee added onto your balance due. If you are a no call no show to any set appointments or fittings, there will be an additional $25 fee added onto your balance due. If you miss a deposit window for any payments due by a specific date, there is an additional $100 late fee added to your remaining balance. 

No Third parties 

This agreement is solely between the Company and the client(s) who are purchasing and or therefore wearing the custom-made garment(s). There will be no third parties included in the design or changes of said design once the agreement is made in this contract between Jess Nicole Collections LLC , and its Client(s).  If your name is not included in or on this contract, Jess Nicole Collections LLC  and its included designer(s) are not obligated to discuss this agreement or its details with anyone other than the parties in this binding agreement. This contract cannot be binding with a minor or anyone under the age of 18 years of age. 

Photo Release

All garments created by Jess Nicole Collections LLC  and its design team will have full publishing and posting rights of its clients and or models wearing garments, fabrics and or accessories for the use of advertisement, social media, online publications and marketing purposes. Photos will be taken during client fittings for alteration correction purposes. There is constant 24hour video surveillance in and around the premises for the safety of  Jess Nicole Collections LLC  ,Its employees, clients and associates. 

Covid -19 Clause 

We are well aware that we may still be dealing with the pandemic into 2021or beyond. However, pricing has not and will not change. All contractual agreements are to be paid in full regardless of cancelled or unattended events. If you are unsure or unable to foresee paying off your garment in the future, please do not proceed with the booking process. Mask are required at each appointment. Refusal of Services

Jess Nicole Collections LLC can refuse services without a refund to the client, if the client becomes harassing, menacing, threatening to the company or its employees about any services being rendered. Any vandalism or damage of any company property by a client will be followed up by lawful consequences. Please be respectful.
